By participating in this activity, I and other associated parties, agree to Positive Pedals' terms and conditions.

By participating in this activity, I and other associated parties:

Release Positive Pedals, its staff, personnel, volunteers or any other representatives of the organisation(s) or associated organisation(s) of any liability in the event of any loss, damage and/or injury, death (or similar), sustained or allegedly sustained during the use or storage (or any other associated activities) of the bicycle(s) and related equipment and materials.

In particular, I am aware that if I, or any associated hirees, injure a third party, or damage third party property through their own or my negligence, that this is not the responsibility of Positive Pedals. Users are advised to have adequate insurance in place for such events prior to usage.

Acknowledge that the ‘bike’, ‘equipment’, ‘accessories’ and any other nouns or descriptors may refer to their singular or plural form. Pronouns such as ‘I’, ‘my’ refer to myself and associated parties.

If hiring multiple bikes under the same name, I acknowledge that the person signing this declaration and/or paying for the services, has the responsibility to ensure that other users are aware, understand and adhere to this declaration.

Acknowledge that the bike and any equipment I receive has/have been safety checked by suitable personnel and as such, the bike and any other associated materials are fit for use on release.

Agree to use and care for the bike responsibly and sensibly and store the bike in a safe place using good quality security locks.

I acknowledge that any charging or associated processes occur at my own risk or that of associated parties.

In particular, I acknowledge that if I decide to charge the bike that I will fully comply with its instruction manual; that I will only use original parts; I will not manipulate the bike or associated electric equipment in any way; I will remain compliant with local and national laws, policies and regulations at all times; that I will not leave the bike/battery unsupervised; that I will adhere to all relevant local and national fire and safety regulations; that I will observe any unusual occurrences and react promptly in case of malfunction or suspected malfunction (i.e. overheating of battery, damage to cables, etc.); that I will not charge the bike overnight and that I will comply with any additional terms and conditions set by other relevant parties during the charging process (i.e. the accommodation I am staying in; land or property owner, etc.). I acknowledge that this list is not exhaustive and that I will take other reasonable precautions and steps during the charging process or associated processes.

Will not interfere with any electrical equipment on the bike in any form.

Will not interfere with any safety critical items on the bike in any form except during normal usage.

Acknowledge that cycling and associated activities are strenuous and that I have no medical and/or other conditions hindering me from safely participating in such activities.

Acknowledge to remain observant of changing conditions (i.e. weather, changes in surface conditions) and that I am strongly advised against using the bike in conditions that may compromise my safety or those of third parties.

Acknowledge to use the bike with due care and that failure to comply with/negligence of this requirement may incur additional charges (i.e. costs (including staff time and other reasonable costs) to replace or fix materials.

Agree to use the bike according to local, regional and national policies, regulations, and laws. I agree to abide by the Highway Code at all times.

Agree to store and use the bike in accordance with fire safety regulations and policies.

Acknowledge that I am strictly prohibited from swapping, selling, dismantling, giving away or discarding the bicycle and agree that I am obliged to return it.

Acknowledge that failure to return the bike and or any improper use of the bike will be reported to Police Scotland or any other relevant authorities, which may lead to further legal consequences.

Realise that I am strongly advised to use a certified, suitable, in-date, non-compromised crash helmet while cycling and that Positive Pedals has offered and provided me with such. I agree to inform Positive Pedals immediately and prior to taking the bike away if such equipment is missing and/or not suitable for its intended use.

Realise that my bike may be equipped with a location tracking system and that my location and that of associated parties may be trackable during the use of the bike.

Realise that I need to use suitable lights and reflectors complying with local, regional, and national requirements.

Understand that I can be excluded from participating in this activity at any time if I fail to comply with the conditions outlined in this disclaimer and/or other instructions provided by Positive Pedals personnel.

Understand that cycling in traffic carries additional risks and that I need to comply with the requirements set out in the Highway Code.

Agree to carry out a visual and basic inspection of the bike prior to using it and that I will inform relevant representatives of Positive Pedals of any faults I observe.

Agree that I shall immediately stop using the bike in the event of any faults or failures occurring during its use.

Agree that I will stop using the bike immediately if I observe - or in any other way suspect or come to be informed - that the safety of the bike is compromised in any way.

Agree that relevant data may have to be shared with other relevant parties such as Cycling UK, Cycling Scotland, Hitrans, etc. and that they or Positive Pedals, may contact me for monitoring, evaluation and potentially other purposes.

Agree that my data is stored in accordance with Positive Pedals’ privacy policy.

I am aware that I may be charged a deposit for each bike and that I am required to have sufficient funds in my bank account to cover those.

I agree that I may be charged a late-return fee.

I agree that I may be charged for any damage(s) or similar resulting from non-compliance with the above.
